1. Information about the Data Processor and person for the protection of personal data
The purpose of this Notice is to provide information on the processing of personal data of the Supplier who is natural persons (entrepreneurs), the Supplier's representatives who are legal entities, as well as the Supplier's contact person, e.g. driver/delivery person of the Supplier ("You") by METRO CASH&CARRY DOO BELGRADE, a company with its registered office at Autoput za Novi Sad 120, Belgrade, Republic of Serbia, with registration number 17482700 ("METRO"), which in terms of the Law on the processing of personal data (*1) ("the Act") is considered the controller of your personal data and is responsible for its processing, as explained below.
Any processing of personal data by the Controller will take place in accordance with the Law and other by-laws that regulate the area of personal data protection.
METRO has appointed a person for the protection of personal data. You can contact the Data Protection Officer at any time at the e-mail addresses: zastitapodataka@metro.rs and/or dataprotection@metro.rs
2. Types and sources of collection of your data processed by METRO
METRO will collect and process, if necessary, your personal data, including but not limited to the following:
- data of the supplier who is a natural person (entrepreneur): name, surname, TIN, ID number, JMBG and other data and/or documentation publicly available at the Agency for Business Registers and/or other public registers, VAT number, bank account number, IBAN (foreign suppliers only), SWIFT code (foreign suppliers only), information on the registered office address, order address, payment address and return address, for each address: street and number, postal code, city, name and country code , videos from METRO surveillance cameras, vehicle registration number;
- data of the representative of the Supplier who is a legal entity: name, surname and function; and
- data of the Supplier's contact person and driver/delivery person: first and last name, phone number, e-mail address, identity card number and video footage from METRO's surveillance cameras (only for drivers/delivery people),
(hereinafter collectively: "Personal Data").
METRO collects Personal Data directly from you, in communication with the Supplier, or from publicly available sources.
3. Purpose of processing and legal basis for processing Personal Data
METRO personal data is processed by:
- for the execution of the contract on cooperation with the Supplier and taking actions for the conclusion of the contract on cooperation between METRO and the Supplier for the purpose of fulfilling the obligations stipulated in the contract, payment of invoices, posting of goods and cost invoices, daily business with the Supplier, etc.;
- in order to comply with its legal obligations and for the following purposes: tax payment, statistical and research purposes, as well as other obligations towards competent authorities, as well as on the basis of participation in any court or other dispute for the protection of our rights; and
- in order to realize their legitimate interests and for the following purposes: assessment of the Supplier's financial solidity, IT support - use of programs and applications, protection of property and persons for which purposes video surveillance is carried out, examination of possible fraud committed by the Supplier, monitoring whether there are sanctions against the Supplier (eg trade or financial sanctions), detection and prevention of illegal behavior in relation to METRO by the Supplier, conducting business audits and investigations to determine the existence of debts due to METRO.
4. Recipients of Personal Data
METRO may make Personal Data available to third parties, including service providers (e.g. security, accounting, auditing, legal, IT services, etc.), courts and other state authorities (at their request), as well as METRO Group member companies.
5. Transfer of Personal Data abroad
For the purpose of establishing a unique system of automatic data processing for all member companies of the METRO Group, METRO transfers Personal Data to the countries where the unique SAP centers of METRO's founders are located, namely the Federal Republic of Germany and other signatory countries to the Council of Europe Convention on the Protection of Persons in relation to on the automatic processing of personal data ("Convention"), which are on the list of countries in which an adequate level of protection of personal data is considered to be provided, adopted by the Government of the Republic of Serbia. METRO also exports Personal Data to India (which is not a signatory to the Convention), where METRO's service centers are also located, i.e. the corresponding member of the METRO Group that provides METRO with billing, accounting and invoicing services. For the transfer of personal data to India, METRO ensured the implementation of appropriate protection measures regulated by Article 65, paragraph 2 of the Law (SCC - standard contractual clauses prepared by the Serbian Commissioner for Information of Public Importance and Protection of Personal Data), with the aim of obtaining For more specific information in this regard, you can contact METRO's personal data protection officer at the e-mail address from point 1 of this Notice.
6. Period of storage of Personal Data
METRO stores the Personal Data until the expiration or termination of the contract with the Supplier, or within another period that is reasonably necessary considering the purpose of processing the Personal Data. The period of storage of Personal Data can be extended in the case that the Personal Data is relevant for the needs of court proceedings, investigations, or if this longer storage period is determined by applicable regulations.
7. Your rights
In connection with the processing of Personal Data by METRO, you have the following rights:
- the right to access Personal Data;
- the right to correction, amendment, deletion and limitation of processing;
- the right to object (termination of processing);
- the right to portability of Personal Data; and
- the right to file a complaint with the Commissioner for Information of Public Importance and Personal Data Protection.
You submit a request regarding of your rights to METRO in written (or electronic) form. METRO may limit your rights in connection with the processing of Personal Data, in cases prescribed by the Law.
8. Obligation to provide Personal Data
The provision of personal data to METRO is based on free will. However, the collection of certain Personal Data by METRO is necessary for the conclusion and fulfillment of obligations from the cooperation agreement between the Supplier and METRO. In the event that you or the Supplier refuses to provide such Personal Data, METRO will not be able to conclude and execute the mentioned contract. During the Personal Data processing activities described in this Notice, METRO will respect the obligation to keep Personal Data confidential, in accordance with the Law and other relevant regulations.
